Bill Carlisle has joined the Council as Vice President.

Pointe Owners:
Greetings from stormy Bethany Bay. 
Many Pointe Owners have contacted us about Mr. & Mrs. Higgins' emails and snail mail letters relating to the Pointe Construction project, the actions of your Council, and the qualifications of Mr. Steven Szypulski, of American Home Inspection Technologies LCC, the Pointe consultant. 
In addition, Ms. Higgins contacted Attorney Bob Valihura directly.  Mr. Valihura contacted the Council and asked us about Mrs. Higgins' correspondence and whether or not the Pointe Council wanted him to do research on her allegations.  Since Ms. Higgins had contacted Mr. Valihura and expressed her serious allegations and concerns, the Council agreed that Mr. Valihura was probably the best independent person to do the research and report the results to the Pointe owners.
Attached is Mr. Valihura’s letter to Mr. & Ms. Higgins.  Please take the time to read this letter.
A recap of Attorney Valihura's findings follows: 
   Under the Condominium's Declaration and Delaware law, Council has full power and authority to have executed such a contract with the Contractor.  Council had votes of the community to support this decision.
American Home Inspection Technologies LCC is a Delaware Limited Liability Company in good standing with the State of Delaware;
All business taxes relating to that LLC have been paid;
AHIT is also licensed to do business in the State of Delaware by the Department of Revenue;
Prior to the retention of AHIT, Council made all reasonable and appropriate inquiries into locating the appropriate professional who could advise Council with respect to the issues related to the project; 
Mr. Valihura made a thorough review of the public records concerning AHIT and AHIT’s principal, Mr. Szypulski.  Mr. Valihura reviewed all legal and public records which he deemed pertinent to such an investigation.  Mr. Szypulski cooperated fully, and provided the attorney with all information and explanations which were requested.
     As a result of Mr. Valihura's  investigation and Council’s own investigation, Council is satisfied that there are no issues which raise any question regarding the fitness, qualifications or professionalism of Mr. Szypulski and AHIT.
 
          We hope this puts these unfortunate matters to rest.  The contract with RDM, Inc. is signed,.  We need to spend our time and efforts dealing with the day-to-day construction issues that will arise.

CONSTRUCTION SCHEDULE IS AT THE END OF THE RDM CONTRACT.  THIS WILL BE REVISED FROM
TIME TO TIME AS WEATHER IMPACTS THE SCHEDULE.  THIS SCHEDULE WILL STOP AT MEMORIAL DAY
TO LABOR DAY
 
THE POINTE COUNCIL WILL EMAIL EACH RESIDENT BEFORE CONSTRUCTION ON THEIR BUILDING
BEGINS.  IF WE DO NOT RECEIVE AN EMAIL CONFIRMATION, WE WILL TRY TO LEAVE A VOICEMAIL
 
RDM STATES:  As each building comes into the repair cycle, all
the owners are responsible to clear and remove fixtures and furniture from
window areas for us to start. If we have one unit remiss in their obligation, it
would be difficult to initiate the repair, so owner timely compliance is
imperative. I discuss and focus on this aspect with Dave on Tuesday.

 
RDM PROCEDURES
 
common areas:
- once the landscape is removed by the Association and the new common area
condition is established, we will photograph each building before we begin
repairs. We will assume responsibility for our disturbance in the work areas and
restore w/ grading and seeding upon completion. 

- We intend to set up the storage, dumpster and toilet facility to the "island"
portion of the parking lot.  We will photograph these areas before we set up.
There are no heavy delivery trucks involved with this work.  However, the
dumpster's require a return drop-off after each pull.  Should the asphalt's
integrity be damaged by this operation or any other of our work, we will assume
responsibility in the work areas to repair/patching the area damaged.

Interior:
- we will photograph each unit's condition after Owners clears and remove all
materials in the work areas and before we begin "cutting" the caulk around the
window. If the Owners comply with the directives, there should be minimal
opportunity to damage the unit. We need to only to enter unit twice, once to cut
and another to recaulk.

The photographs referenced are an integral part of our work procedure.  These
photos establish a base line for existing conditions and extent of either common
area restoration or interior damage repairs.
